1. Eligibility

Violation may result in immediate suspension or termination.
General Responsibilities
You agree to:
- Engage respectfully with others, maintaining a positive exchange environment.
- Not share misleading, offensive, or inappropriate content.
- Avoid harassment, bullying, discrimination, scamming, or illegal activities.
- Refrain from commercial solicitation or unauthorised advertising.
- Report inappropriate behaviour or content.
- Not attempt to disrupt platform functionality.
- Respect user privacy and not share personal information without consent.
- Not use any scraper, crawler, or other automated tools of any kind to access or copy this site.
- Not use AI technologies to, directly or indirectly: collect, train on, process, copy, distribute, share, or create content based on tokimonki materials from this site.
We reserve the right to permanently remove or ban users who violate these terms at our sole discretion.
3. Language Exchange Sessions
- Sessions are held via our Microsoft Azure video conferencing.
- AI may assist with note-taking, translations, and conversation prompts.
- Users will receive reminders via email before scheduled sessions.
- Feedback and ratings after sessions improve accountability.
- We are not responsible for user disputes or misunderstandings.
- Sessions may be monitored to ensure compliance with guidelines.
4. Messaging and User Content
- Users can communicate via built-in messaging features.
- You are responsible for the content you share.
- Messages may be reviewed if reported for violating these Terms.
- We reserve the right to remove inappropriate content.
- Avoid sharing sensitive personal information via messages.
Your Content: By submitting your content to the tokimonki platform, you give tokimonki permission to use, distribute, reproduce, publish, adapt and communicate your content worldwide, without paying you royalties, for as long as copyright lasts. This permission only applies when connected to your use of their services.
Tokimonki Content: You acknowledge that all rights (including copyrights, patents and trademarks) in the tokimonki products (“tokimonki Content”), except for Your Content, belong exclusively to tokimonki and/or its licensors. No ownership of any tokimonki Products, tokimonki Content, or other products/services made available by tokimonki will be transferred to you through this agreement. tokimonki grants you a limited, non-exclusive, revocable licence to display and reproduce the tokimonki Content (excluding software code) only for your personal use of the Services according to these Terms.
5. Reporting Users
- Report misconduct or inappropriate users via in-app reporting or support@tokimonki.com.
- Our moderation team reviews reports and may issue warnings, suspensions, or bans.
- False reporting may lead to penalties, including suspension or termination.
6. AI Assistance and Data Use
- AI processes conversations in real-time for language support.
- AI-generated translations and suggestions may not always be accurate.
- We do not store full audio recordings; anonymised data may be analysed to improve AI features.
7. Account Suspension and Termination
We may suspend or terminate accounts if users:
- Violate these Terms.
- Engage in disruptive or inappropriate behaviour.
- Use the platform for non-language exchange purposes.
- Provide false or misleading information.
Terminations are final, and banned users cannot re-register.
8. Subscriptions, Billing, and Refunds
- Tokimonki offers monthly and yearly subscription plans, which are billed via Stripe.
- Your subscription will automatically renew unless cancelled prior to the end of the current billing cycle.
- You may cancel your subscription at any time. If cancelled, you will retain access to the paid features until the end of the current billing period.
- No refunds will be provided for unused time within a billing cycle.
- If your account is terminated by tokimonki for violating these Terms, your access to the platform will be revoked immediately, and no refunds will be issued.
- It is your responsibility to ensure timely cancellation if you no longer wish to be billed.
9. Limitation of Liability
- We are not liable for user interactions or inappropriate conduct.
- We do not verify user-provided information.
- Services are provided “as is” without warranties.
- Use our platform at your own risk.
- We disclaim liability for disruptions or technical issues beyond our control.
10. Indemnification
You agree to indemnify tokimonki from claims, liabilities, damages, losses, and expenses arising from your platform use or violations of these Terms.
11. Changes to These Terms
We may update these Terms at any time, communicating significant updates via email or notifications. Continued use indicates acceptance of revised Terms.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising under these Terms will fall under the exclusive jurisdiction of New South Wales courts.
